High Court ruling on significant legal case
(5 November 2021) ReturnToWorkSA applied to the High Court of Australia for special leave to appeal the Supreme Court’s decision in the matter of Summerfield. The matter was heard today and special leave was not granted by the High Court.
This decision brings with it a material adverse impact on the Scheme’s outstanding claims liability and health outcomes focus and in doing so represents a significant affordability and durability challenge.
Many work injury claims will be impacted by this decision and ReturnToWorkSA is working diligently to implement and apply this outcome in accordance with the circumstances of each individual worker’s claim that is affected.
