Freedom of information

You can apply under the Freedom of Information Act 1991 (commonly known as FOI) for access to information held by ReturnToWorkSA.

How do I request information?

You can make a request by submitting a written application or by using our FOI application form. Along with your application, you will need to include a cheque to cover the application fee.

We will contact you within two days from the date your application is received to let you know if it has been accepted or if we are unable to process your request.

We will usually process your request within 30 days from the date your valid application is received.

In most cases, the information will be saved electronically to a disk and sent to you by registered post.

Fees and charges apply unless you are a concession card holder.

FOI disclosure log

The Government has committed to the establishment of disclosure logs for all government agencies to provide central access to non-personal information that has been released under the Freedom of Information Act 1991 (FOI Act).

Premier and Cabinet PC045 Disclosure Log Policy requires agencies to publish information and documents that have already been disclosed to an FOI applicant that:

  • are not related to the personal affairs of an individual;
  • could not be claimed as exempt documents/material pursuant to Schedule 1 of the FOI Act, when being publicly released; and
  • could not be considered defamatory or a breach of confidentiality or reasonably be anticipated to cause harm to a person.

Information about your claim

You and your legal representative can make an application under Section 180 of the Return to Work Act 2014 to access information held by ReturnToWorkSA about your claim. You can apply for a copy of your whole claim file or specific documents or information from within it.

If you are applying on behalf of a person with a work injury, you will need their written permission to access their information. We are committed to protecting the privacy of the personal information we hold.

How do I request information about my claim?

You can make a request by submitting a written application or by using our Section 180 Application for Access form (PDF, 107 KB).

Once we have received your request, we will let you know in writing if we have accepted your application, or contact you if we are unable to process your request.

We will process your request within 45 days from the date your application is received.

In most cases, the information will be saved electronically to a disk and sent to you by registered post.
