Access to copies of worker documents

Information can be requested from ReturnToWorkSA and its claims agents Gallagher Bassett and EML. Depending on the type of information being requested, there are different legal and legislative mechanisms under the Return to Work Act 2014- external site- external site- external site- external site and Freedom of Information Act 1991- external site- external site- external site- external site that facilitate that request.

Employer requests for information

As an employer, Section 179 of the Return to Work Act 2014 outlines specific medical claims information that you can access direct from the claims agent managing the claim. This only relates to claims that are attached to your business. Requests can be made by you as the employer or a nominated representative.

It is reasonable for an employer to obtain other documents related to the claim which could be obtained during the standard claims management process.

Identity checks will need to be completed prior to the disclosure of information and, should a third party to the employer be requesting the information, a valid and current letter of authority from the employer will need to be provided.

Worker requests for information

You or your legal representative can make an application under Section 180 of the Return to Work Act 2014 to access information held by ReturnToWorkSA about your claim.

If you are a legal representative applying on behalf of a person with a work injury, you will need their written permission to access their information. We are committed to protecting the privacy of the personal information we hold.

How do I request information about my claim?

Once we have received your request, we will let you know in writing if we have accepted your application, or contact you if we are unable to process your request.

How do I request information?

If you are seeking personal information, you will need written permission from the person whom the information relates to.

Along with your application, you will need to include a payment to cover the application fee- external site- external site- external site- external site.

In most cases, the information will be saved electronically to a disk and sent to you by registered post.

FOI disclosure log

The Government has committed to the establishment of disclosure logs for all government agencies to provide central access to non-personal information that has been released under the Freedom of Information Act 1991 (FOI Act).

Premier and Cabinet PC045 Disclosure Log Policy- external site- external site- external site- external site requires agencies to publish information and documents that have already been disclosed to an FOI applicant that:

  • are not related to the personal affairs of an individual;
  • could not be claimed as exempt documents/material pursuant to Schedule 1 of the FOI Act, when being publicly released; and
  • could not be considered defamatory or a breach of confidentiality or reasonably be anticipated to cause harm to a person.
